By completing this registration process digitally, the member accepts by its mark hereunder that the terms and conditions of the Membership Agreement and Rules of Membership of the Club set out herein and ticked by the Member together with the provisions of the Club’s Constitution are binding. In particular there is an acceptance by the member that the Sumthn Dank constitutes a private physical space and a private digital domain for members only.

The Club Member accepts full responsibility for use of any gifts or services that they have earned or obtained through the club and indemnifies the club in accordance with the Rules of the Club set out on this page..

Agreement between the Sumthn Dank Club and the Member.

Preamble.

Members of our private and exclusive Club who have been vetted as adults are able to enjoy the beneficial effects of cannabis, legally and as responsible adults, as provided in The Cannabis for Private Purposes Act No 7 of 2024. The privacy of the club and the exclusive services afforded to Club members ensures compliance with the judgment on private space and usage. 

Categories

There are different tiers of membership each of which entitle members to safe consumption and ingestion of the Club’s exclusive and quality products. All categories enable the Member to participate in the private club, namely the Sumthn Dank Cannabis Club.

Rights and Obligations 

1. Members shall be rewarded in a manner suitable with their status and their preferred forms of consumption. 

2. Members shall qualify for a variety of member benefits including apparel, T-shirts and hats. They shall further qualify for prizes as set out in the quarterly newsletter. 

3. The Club offers a full bouquet of the finest expertly curated product. The Club sources products from the length and breadth of our fertile country. 

4. Members will qualify for significant discounts on products and all our leading brands. You may be requested from time to time to be part of a group of members who agree to test new products under our indemnity below. 

5. Members shall have the right to attend exclusive events that will include live music, food and safe cannabis goodies. 

6. The benefits of club membership shall be access to the fine cannabis products of the CLUB. 

7. All club members shall be entitled to share the products in our outlets and online. 

8. Members shall receive regular online messages packed with real relevant information. They shall relate to new products and their myriad of health benefits, and to promotions and events of the Club. It will advise of the trends and products throughout the world in relation to usage and health. 

9. There are various categories of membership that will apply, each dependent on membership contribution per month. All members shall be rewarded relative to their status. 

10.The Member is an adult major who is fully cognizant of the responsible use of cannabis and undertakes to observe the Rules of the Club. Accordingly the Member indemnifies the Club and its managers from any liability arising out of abuse of cannabis by the Member. 

11.By joining as a member of the CLUB the member hereby gives consent to the CLUB and its managers to process its personal information, in accordance with the provisions of the Protection of Personal Information Act for all purposes related to the carrying out of their mandate. 

12.The Member hereby agrees that once the correct Credentials to the Member’s account have been entered, irrespective of whether the use of the Credentials is unauthorized, the Member will be liable for payment subscription signed for on the application form, save where the subscription is cancelled by the Member in accordance with this Agreement. 

13.The Member hereby agrees to notify the Club immediately upon becoming aware of or reasonably suspecting any unauthorized access to or use of the Member’s Credentials and to take reasonable and necessary steps to mitigate any resultant loss or harm. 

14.The Club reserves its right to terminate unconfirmed and/or inactive accounts. In addition, the Club reserves its sole and absolute discretion to refuse or to terminate all or part of its services to the Member for any reason whatsoever.

By completing this membership form, I acknowledge that I understand and agree to the following:

I hereby give consent to Sumthn Dank Cannabis Club to collect, store, and process my personal information, including but not limited to my name, ID number, contact details, and any other information provided in this form, for the purpose of membership administration, communication, and compliance with applicable laws.

I understand that:
    •    The Club will take reasonable steps to protect my personal information from loss, misuse, or unauthorised access.
    •    My information will only be used for purposes directly related to the operation of the Club and will not be shared with third parties without my express consent, unless required by law.
    •    I may request access to my personal information and may request correction or deletion where appropriate.
